[1] SPG Upper Floor Membership Regulations

The SPG Upper Floor Membership Regulations fix the necessary rules to observe in order to keep the SPG Upper Floors to be a sound playground for adults. SPG Upper Floor Members (hereinafter called "SPG Members") must obey these rules.
Those who wish to apply for the SPG Upper Floor Membership must read and agree on these regulations. Read them carefully before the application.

[2] SPG Forum

The SPG Forum offers you a meeting place for SPG Members, where people with the same interests can exchange with each other by displaying photos and images in the libraries on the Internet Home Page. In addition, it holds photography meetings, promotes members' mutual friendship, and upload their photo images in the data libraries on the SPG Home Page. The above activities will activate the libraries and promote members mutual friendship. It also leads to the increase in number of the guests who wish to see such images, and results in activating the Forum itself. Thus this Forum aims at expanding the communication through images and taking pictures.

[3] As for personal computers, telecommunication equipment and other peripherals together with software to use to access this service, each SPG member shall install at his/her own cost and charge. The access and use of this service will be made with the user ID and the password provided by SPG. Each SPG Member must keep his/her password secret for himself/herself. SPG will never disclose the passwords of SPG Members for any reason. The access to this service without permission will be the breach of contract and thus you will be violating laws.

[4] Scope of these Regulations

The SPG Upper Floor Membership Regulations are the rules to be observed by all who wish to be SPG Upper Floor Members. The Members must consent to them. Those who apply for SPG Upper Floor Membership, are admitted by SPG and pay for the membership fees will become SPG Members (only for the period of valid membership), and must sign the contract to observe these regulations. Those who quit intentionally, are forced to quit due to the breach of regulations, or have their membership expired will no longer be SPG members and not bound to this contract.

[5] Amendment of these Regulations

The SPG Upper Floor Regulations may be amended without the prior notice to SPG Members. In case of amendment of these regulations, we will immediately inform each member of such amendment. Upon the notice, the amendment shall be valid. SPG Members cannot object to the amendment of these regulations.

[6] SPG Upper Floor Members

Those who approve of these regulations and complete the application procedures for SPG Upper Floor Membership in accordance with the stipulated procedures will receive a user ID and a password. During their valid period, such persons are considered to be SPG Upper Floor Members. SPG Membership is not assignable to others in any case. Only an individual can be a SPG member and a legal person cannot apply for the membership.

[7] Qualifications and Approval of Membership

SPG stipulates the following conditions as qualifications for the application of SPG Upper Floor Membership. SPG shall permit the application accordingly.

1) Japanese who are 18 years old or older
Foreigners who are 21 years old or older
2) Those who like images and taking pictures and wish enjoyable exchange in this forum
3) Adults of common sense who will not violate public order and standards of decency
4) Those who pay for the stipulated membership fee

In the following cases, SPG may not approve the application. In case SPG finds the following conditions after the approval, SPG may cancel the membership.

1) Content of application is not true, lack of information, mistakes
2) The applicant is a Japanese less than 18 years old, or turns out to be so later.
3) The applicant is a foreigner less than 21 years old, or turns out to be so later.

[8] Prohibited Activities and Lapse of Membership

Prohibited Activities

In case SPG Members performs or are deemed to perform the following activities, they shall lose their membership. The members cannot object to such decisions. In such cases, prepaid membership fees shall not be reimbursed.

1) To reuse, copy, sell nor publish any information obtained through SPG. Members may be able to reuse their own data for publication, etc. upon prior deliberation with SPG.
2) To use others' ID or Password without permission.
3) To slander a specific individual, group, country or race in the electronic meeting, data libraries or online meeting.
4) To violate others' privacy.
5) To violate copyrights and rights to portraits.
6) To reproduce the data in SPG on other media.
7) To violate the SPG Upper Floor Membership Regulations.
8) To obstacle the management of SPG.
9) To perform profit-aiming activities in SPG without SPG's permission.
10) To be deemed to violate laws in SPG.
11) To perform specific religious activities and political activities.

Lapse of Membership

In the following cases, SPG Members lose their membership. In such cases, the prepaid membership fees shall not be reimbursed.

1) In case the Member submits the notice of withdrawal to SPG and that SPG approves of the intentional quitting.
2) In case the Member is forced to quit due to the breach of SPG Upper Floor Regulations.
3) In case the Membership is expired.

[9] Scope of SPG's Responsibilities

1) SPG shall not be responsible for any trouble on SPG between the members.
2) SPG shall not be responsible for any trouble concerning the members' personal computers, peripherals or software occurring when accessing to SPG.
3) SPG shall not be responsible for any telecommunication disturbance by other media or lines, leak of information, theft of records, destruction occurring when accessing to SPG.
4) SPG shall not be responsible for any trouble concerning busy lines and bad telecommunications.
5) SPG shall not accept any complaint of the delay of payment due to the trouble at the bank or other external factors. In such a case, SPG shall not respond to the inquiry from the SPG Member.

[10] Protection of Privacy

SPG shall not disclose the personal information obtained in SPG application to other than SPG management members for any reason.

[11] Confidentiality of Telecommunication

SPG shall not offer confidentiality services for the secret of individual or group. Data in SPG except for personal information to be protected in accordance with (9) are deemed to be common to the members. Please refrain from using SPG if you wish to send secret data to a specific individual or group. In case unintended individual or group sees such data, SPG shall not responsible for any trouble arising from such conditions. SPG System Management may and are permitted to read any form of data.

[12] Standards of Registration of Data in SPG

The registration of data in SPG should comply with the present Japanese laws (April, 1996). Masking procedures are required for images which may violate public order and standards of decency. However, the following types of images may not be allowed to register in spite of masking procedures.

1) Images of infants
2) Images of juniors (It is allowed in case the subject is not a student and that the consent of the subject and his/her parents.)
3) Images without the consent of the subject (Pictures taken by a hidden camera are not allowed.)
4) Images greatly violating other people's privacy
5) In case profit-making purposes, political activities or religious activities are recognized.
6) In case the content violates Japanese laws

[13] Obligation of Notice

SPG Members shall notice SPG without delay in the following cases.

1) When the credit card used for this service loses validity or is expired.
2) When the credit card used for this service is stolen.
3) In case of changing the name due to the marriage or other circumstances
4) In case of changing the address
5) In case the ID or the password is stolen
SPG shall not be responsible for any losses occurred between the date when the ID or the password is stolen and the date of reporting the accident to SPG.

[14] Membership Fees

Only the members can access the SPG 2nd 3rd and 4th Floors.

2F3F4F 1,900 Japanese Yen/month in case of advance payment in a lump sum

(1 month means 30 days here.)

2F3F4F 15,000 Japanese Yen/year in case of advance payment in a lump sum

(1 year means 365 days here.)

SPG Members who have paid the above membership fees and are allowed to access the 4F will be permitted to access the 3F at the same time. The members allowed to access the 3F may not apply for the access to the 4F until the expiry of the validity. The term of validity shall begin on the day when SPG receive the payment and allow the access and continue to be valid for 30 days. Payment shall be accepted by Visa or Master Card.

[15] Renewal of the Term of Validity

The term of validity shall be renewed automatically for an additional term when SPG confirm the payment of the member fee for a new term through the bank during the period of 10 days prior to the expiration date. In this case, the term of validity shall be extended to the total of the remaining days of the current term and those of the new term. The user ID and the password shall not be changed. SPG shall not inform the member of the extension of the term of validity, and members are requested to remember it for themselves.

[16] How to be a SPG Member

[17] Supplementary Provision

The suit over any disputes or controversies which may arise between SPG
and a SPG member in connection with this agreement shall be filed in
a court of the first instance appointed by SPG.
